Family law is the name given to the laws and rules that have been developed regarding the relationships within the family. Family law above all other branches, reflect the values that our society upholds regarding the way that people who are related should treat each other.
There are five main entities within the broad spectrum of family law; marriage, divorce, child support, child custody and visitation, and adoption.  Marriage falls within these groups due to the fact that while marriage is most often based on romance and love, when you enter into it you are entering into a legal and business arrangement. When deciding whether or not to get married, it is wise to consult with an attorney who deals in family law, to discuss finances, prenuptial and premarital agreements. divorce is the act of dissolving an existing marriage. In a case of divorce, family law enters when the parties have to decide such factors such as spousal support, alimony and the division of property. Property division and alimony are two of the most difficult things to agree on and come to terms with in a divorce, and the helpful and early advice of an experienced family law attorney can have favorable results for both parties. The law states that parents must support their children. This financial duty is in place until the minor child turns either 18 or 21 depending in the particular state. In the case of a divorce, or single parent situation, the parent who wins or retains custody has the legal right to petition the other parent for child support. If the parent who is responsible for paying support refuses to pay, there are legal repercussions through the family law courts. The non-compliant parent faces losing his or her driver’s license, and in some cases, their business license. They also face spending time in jail for not paying what they owe. Because the child support issue can be so difficult to enforce and collect on, a person stands to benefit from hiring a family law attorney to act in their best interest, and in the interest of the child. Child custody and visitation are two areas in which an attorney with a family law background can be of great assistance. The attorney can help all parties involved make the best decisions possible for the child/children involved, and ensure that the child’s best interest in the main focus.
adoption can be a tricky avenue to negotiate, and it is imperative to have an experienced and trustworthy family law attorney navigating it with you. Each state varies in how they handle adoption, and the laws are different from state to state. Finding a family law attorney who handles adoption and all related services, can help make the transitions easier for both the birth parents, and the adoptive parents.
Family law encompasses numerous issues, and because it is specific to relationship, the list of cases that come up in the family courts number in the thousands. Family relationships can be a cause for numerous legal issues, and include all people with no regard for race, religion, or economic class.
